A federal appeals court overturned a district judge’s decision partially invalidating a Montana law that bars businesses, including health-care providers, from refusing goods, services, or employment based on a person’s vaccination status.
A three-judge panel of the US Court of Appeals for the Ninth Circuit ruled Wednesday that the federal Americans with Disabilities Act and the Occupational Safety and Health Act don’t appear to facially preempt the state law, which was enacted during the height of the Covid-19 pandemic.
