The North Dakota Governor April 10 signed a law concerning corporate income and individual income tax credits for employing individuals with developmental disabilities or severe mental illness. The law includes measures: 1) replacing the term “chronically mentally ill” with “severe mental illness;" 2) increasing the credit to 25 percent from 5 percent of up to $6,000 in wages a taxpayer pays annually for each employee with a qualified disability or illness; 3) requiring a pass-through entity (PTE) entitled to the credit to be considered as the taxpayer for credit calculation purposes; 4) requiring the allowable credit amount to be determined ...
