Oregon’s public services and care provider union can’t be sued for allegedly violating a state worker’s civil rights by deducting dues from her paycheck without consent because it’s not a state actor, the Ninth Circuit said.
Plaintiff Jodee Wright can’t pursue claims for damages against Service Employees International Union Local 503 under 42 U.S.C. § 1983 because the state, not the union, deducts union dues from employee’s paychecks, the US Court of Appeals for the Ninth Circuit said, in an opinion written by Judge Richard A. Paez.
