SYRACUSE N.Y. — The U.S. District Court for the Northern District of New York ordered the owner of a Syracuse gas station and convenience store as well as a Jamesville pizzeria and convenience store to pay $56,364 in unpaid wages and an equal amount in damages to 12 employees who were denied overtime pay.
The court’s action follows an investigation by the U.S. Department of Labor’s Wage and Hour Division into Huseyin Turan, the owner of Liberty Gas Station and Convenience Store LLC in Syracuse and Liberty Pizza & Convenience Inc. In Jamesville.
The investigation found that Turan failed to pay workers overtime wages when they often worked over 40 hours per week; he also failed to keep accurate records, in violation of the Fair Labor Standards Act.
Turan agreed to pay $7,272 in civil penalties assessed by the department.
Department of Labor officials said their investigation also found that employers who didn't pay workers overtime wages attempted to conceal their wrongdoing through a variety of schemes.
These schemes include paying employees with both checks and cash, understating the number of hours an employee worked and requiring employees to sign false records before paying them.
Even after litigation began, officials say employers destroyed time records, resulting in the judge issuing sanctions against them.
