Directive (EU) 2023/970 of the European Parliament and of the Council (EU) 2023/970 on strengthening the application of the principle of equal pay for men and women for the same work or work of equal value through pay transparency and enforcement mechanisms ("Directive") entered into force on 6 June 2023. The Polish government has now published the assumptions of a draft act to implement these EU regulations.
Its provisions aim to introduce measures to increase pay transparency, encourage employers to review their pay structures to ensure equal pay for men and women performing the same work or work of equal value, as well as to introduce legal measures enabling employees who are discriminated against in terms of pay on gender grounds to exercise their right to equal pay.
Pay transparency
The new rules will require all employers (regardless of the number of employees) to have pay structures in place that allow for an analysis of whether employees are in a comparable situation. The minimum requirement is the use of four mandatory criteria for assessing the value of work (skills, effort, responsibility and working conditions). Employers will be able to take into account additional criteria or sub-criteria where appropriate. All criteria must be relevant in an objective and gender-neutral manner.
