Phila. Parking Authority Hit With Labor, Wage Class Action Lawsuit - Law.com

The Philadelphia Parking Authority, with over 1,100 employees across the city, is facing a fair labor and wage class action lawsuit filed by lead plaintiff Terrez McCleary, a security officer for PPA since 2018, and other security officers.

The suit, filed on Monday in the U.S. District Court for the Eastern Distirct of Pennsylvania, alleges that the PPA does not provide adequate lunch or rest breaks to its security officers, instead requiring them to work through their 30-minute lunch breaks without pay.

“During these illusory breaks,” the complaint reads, “Plaintiff and other security officers must remain at their posts, continuously monitor vehicle and pedestrian traffic, respond to customers, conduct security rounds, operate entry and exit gates, and perform other regular job duties.”

In line with those allegations, the class also contends that it regularly works overtime, to which the PPA fails to pay overtime wages.

“As a result of its unlawful break policy, the PPA failed to pay Plaintiff and other security officers (a) straight-time wages for all hours worked under 40, and (b) overtime wages for all hours worked over 40 in a workweek,” the complaint read, “including hours improperly eliminated through automatic deductions.”

The claims are brought under the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law, along with an alternative unjust enrichment claim.
