A 67-year-old female federal prison psychiatrist can sue the US for age and sex bias for allegedly forcing her to resign after failing a physical abilities test, the Fourth Circuit ruled.
A lower court mistakenly concluded that Jane DiCocco lacked standing under Title VII of the 1964 Civil Rights Act and the Age Discrimination in Employment Act because her resignation wasn’t an adverse employment action, the appeals court said Thursday. That conflated the question of standing with the merits of DiCocco’s claims, the judges said.
