A False Claims Act whistleblower’s suit against Publix Super Markets Inc. alleging opioid prescription fraud is dismissed because the complaint is a “shotgun pleading,” a Florida federal district court said.
Whistleblower Publix Litigation Partnership LLP’s complaint failed to adequately state an FCA claim because it is “filled with background information and legal conclusions that have very little to do” with specific claims for relief, Judge Tom Barber of the US District Court for the Middle District of Florida said in a Tuesday order to dismiss without prejudice.
