Sacramento taqueria faces complaint over underpaying, overworking staff - KCRA Sacramento

Overworking, underpaying, and taking tips – those are some of the accusations a Sacramento-area taqueria chain is facing, detailed in a new complaint filed this week by the U.S. Department of Labor.

The complaint alleges that the owners of Taqueria Garibaldi, a local Mexican restaurant chain, deprived their employees of the wages they earned, starting from as far back as May 2018. The defends are listed as Che Gariabldi, Eduardo Hernandez, Hector Manual Martinez Galindo, and Alejandro Rodriguez.

The complaint states several employees “work over forty hours per week, some working over twelve hours per day,” and that many employees had to perform tasks outside the position they were hired for.

The complaint accuses the owners of not paying employees the overtime wages that they earned, saying the owners “failed to pay a rate of one and one-half times the regular rate” and instead would “pay employees by cash for hours worked over forty per week.” The complaint goes on to say that the owners “kept tips received by its employees.”

The complaint also alleges the owners of Taqueria Garibaldi failed to keep an accurate record of hours worked and wages paid to their employees.

Additionally, the defendants are accused of impeding the U.S. Department of Labor’s investigation into the business. In 2021, the Wage and Hour Division of the U.S. Department of Labor started asking workers questions about the labor practices at Taqueria Garibaldi. The complaint alleges the owners told...
