A now inactive Sarasota laboratory will pay $980,000 to resolve allegations it violated the Anti-Kickback Statute and False Claims Act, according to the U.S. Attorney’s Office for the Middle District of Florida.

Allin IP DX LLC — which was based at 1. S. School Ave., Suite 900 — violated the act by paying a marketing service for referrals of Medicare beneficiaries, prosecutors say.

The claims stem from conduct Allin voluntarily self-disclosed, prosecutors say, noting the company cooperated by providing a detailed disclosure statement and other supplemental information that assisted with the government’s investigation.

From Jan. 2 to June 15, 2023, authorities say, the Sarasota laboratory paid independent marketers in exchange for referrals of lab specimens to Allin, which violated the Anti-Kickback Statute and resulted in the submission of false claims to the Medicare program, violating the False Claims Act.

The Anti-Kickback Statute makes it illegal to offer, pay, solicit or receive payment for referrals of items or services covered by Medicare, Medicaid and other federally funded health care programs, to ensure that medical providers’ judgment is based on the best interests of patients rather than financial incentives.
