A Manhattan security guard has filed a class action lawsuit against private security giant Allied Universal, which provides security guards to retail stores, hospitals and other companies, alleging the company failed to pay proper overtime and keep track of hours worked.
Shareida Spencer filed the suit in state court in Manhattan on Wednesday. According to court documents, Spencer worked for Allied Security for nearly two years, ending in June 2022. She was scheduled between 40 and 65 hours per week and paid $25 per hour. As a non-exempt employee, she was entitled to overtime payments of 1.5 times her regular rate under state law.
The suit alleges that Allied Universal failed to pay the proper overtime rate when guards worked over 40 hours per week. The suit also alleges Allied Universal required Spencer and other employees to complete tasks outside of their shifts without pay, like loss prevention and escorting people to other locations, estimating this added two to three hours per week of unpaid work.
Sherita Coffelt, vice president of communications North America at Allied Universal, said the company cannot comment on pending litigation. Lawyers for Spencer did not respond to multiple requests for comment.
As a class action, the suit would allow other security guards who worked for the company in the past six years to participate. The class is seeking back wages for unpaid overtime, plus $250 for each day workers were not provided with an accurate wage statement,...
