A settlement has been reached in a class action lawsuit against Shutterfly LLC that claimed the company engaged in deceptive advertising by advertising purportedly improper discounts on merchandise sold in its e-commerce store, Shutterfly.com.
The settlement class is made up of anyone who purchased one or more products from shutterfly.com during the class period of April 1, 2018, through Aug. 25, 2023, at discounts from an advertised reference price and has not received a refund or credit for their purchase.
The plaintiff claims the defendant is engaged in deceptive advertising by utilizing false reference pricing, which occurs when a seller fabricates a false “original” price for a product and then offers that product at a substantially lower price under the guise of a sale.
In doing so, Rivali asserts that Shutterfly is violating California’s Unfair Competition Law, California’s False Advertising Law, the California Consumer Legal Remedies Act and the Federal Trade Commission Act, which prohibits “unfair or deceptive acts or practices in or affecting commerce” and false advertisements.
Shutterfly, based in Redwood City, California, specializes in photography, photography-related products and image sharing. Its primary focus is on providing personalized photo printing services, such as customized photo books, framed pictures and various items adorned with personalized image prints.
