South Florida restaurants owed workers $18,000 in pay, damages, ignored child labor law - Miami Herald

The operator of Divieto Ristorantes in Estero, Doral and Aventura paid $18,705 in back wages and damages after violating the overtime pay portions of the Fair Labor Standards Act (FLSA), the U.S. Department of Labor announced.

That money went to 58 employees, an average of $2,197.50 per worker.

The restaurants are operated by Restaurant Investment at Bonita, which state records say is run out of North Miami Beach by Eduardo Namnum. A message left by the Miami Herald for Namnum wasn’t returned.

Labor said its Wage and Hour Division investigators found Restaurant Investment didn’t pay workers at the overtime rate when employees exceeded 40 hours of work in a week.

Also, Restaurant Investment let two 15-year-olds work after 10 p.m., a violation of FLSA’s child labor section. That cost the company a $1,382 civil money penalty.

“Denying workers their legally earned wages hinders their ability to provide for themselves and their families,” said Wage and Hour Division District Office Director Nicolas Ratmiroff.

The Wage and Hour complaint section of Labor’s website contains information on how to file a complaint if you believe your employer has violated FLSA. Miami’s Wage and Hour Division office can be reached at 305-598-6607. The national helpline is 866-4US-WAGE (487-9243).

No matter the immigration or citizenship status of workers, they can speak with the department, which says it can handle calls in more than 200 languages.
