SpaceX sues NLRB: In a legal manoeuvre, SpaceX has filed a lawsuit against the National Labor Relations Board (NLRB) following accusations of unlawfully terminating employees critical of CEO Elon Musk.
The lawsuit, lodged in a federal court in Brownsville, Texas, contends that the NLRB's structure, which issued a complaint against SpaceX, infringes upon the US Constitution.
The NLRB alleges that SpaceX violated federal labour law by dismissing eight workers in 2022 who had endorsed a letter criticising Musk's behaviour as "a distraction and embarrassment."
The letter specifically accused Musk of making sexist comments contrary to company policies. The case is slated to be heard by an administrative judge and subsequently by a five-member board appointed by the US president. Decisions by the board are subject to appeal in federal court.
SpaceX's lawsuit challenges the constitutionality of the NLRB's structure, arguing that federal law permits the removal of board members and administrative judges only for cause, not at will. Consequently, SpaceX seeks to impede the progression of the NLRB case.
This legal strategy mirrors SpaceX's recent actions in blocking an administrative case by the US Department of Justice, which claimed the company unlawfully refused to hire refugees and asylum recipients.
