Staff won’t be forced to step down at retirement age from next week - Extra.ie

Staff will not be forced to stand down from their jobs at retirement age if they want to keep working under new rules due to become law next week.

Employees who want to ‘work ’til they drop’, will not be obliged to quit at the official retirement age of 66 under new rules from next Monday.

However, the new rules will also not oblige anyone to stay in work if they wish to retire under the new Employment Act, according to the Employment Minister Peter Burke.

The new right will allow employees to formally notify their employer that they do not consent to retire at their ‘contractual retirement age’.

To do so they must provide at least three months’ notice and no more than 12 months’ advance notification.

Where a contract specifies a longer notice period, employees must give that notice or six months, whichever is shorter.

Due to the minimum notice requirement, the earliest contractual retirement date the Act can apply to is September 29.

According to Mr Burke’s department, employers are required to carefully consider any notification made under the Act.

Where an employer intends to enforce a retirement age, they must respond in writing within one month and clearly set out the decision and ensure that it complies with the higher legal threshold set out in the Act.
