NASHVILLE, Tenn. (WTVF/CNN Newsource/WKRC) - A suspected pregnant shoplifter was shot by a store employee in a parking lot, leading to an emergency C-section.
The Walgreens employee, Mitarius Boyd, claimed he shot Travonsha Ferguson, 24, in self-defense.
Ferguson's baby is alive and undergoing treatment because the infant was born pre-mature.
"We're starting off with an employee who left the inside of a business to go after someone who committed, allegedly, a shoplifting offense, which could very well have been a misdemeanor," said legal analyst, Nick Leonardo. "It would have to be over $1,000, you know, before it would become a felony."
Leonardo said a grand jury will need to decide if Boyd was operating within the law when he shot Ferguson.
"Basically, it has to be a reasonable belief that this force that was needed to protect you from serious bodily injury or death," Leonardo added.
The investigation indicated Boyd was notified that Ferguson and another woman took various items from the store without paying, including cosmetics.
Boyd told police he followed the women to their car and recorded them on his cell phone.
Boyd said one of the women began spraying a can of mace at him.
Boyd said he pulled out his gun and started shooting, claiming self-defense.
