Federal Trial Court in New York Dismisses Plaintiff’s

Employment Discrimination Claims

A federal district court in New York has dismissed employment discrimination claims brought under the

Age Discrimination in Employment Act of 1967 (“ADEA”) and Title I of the Americans with Disabilities Act of 1990

(“ADA”), finding that the plaintiff failed to meet the requirements for asserting claims under those statutes.

The Case

The plaintiff alleged that he began working as a case manager at Hogar, Inc., on May 3, 2022.

According to the plaintiff, two days later, a Hogar program director told him that he “was not a good fit

and that [he] should apply for another job in another place.” Then, the plaintiff asserted, a clinical

supervisor at Hogar “put a handwritten note on [the plaintiff’s] desk saying that [the plaintiff] will not be

able to function as a case manager” even though the plaintiff asserted that he had “the qualifications

and extensive experience in the [f]ield of social services].”
