An Abilene, Texas, police officer and an investigator in the local district attorney’s office are immune from a suit by a suspect who was arrested for making false 911 calls, but a second police officer isn’t, the Fifth Circuit said Thursday.
Officer Jimmy Woods didn’t have probable cause to take Robert Reitz into custody on the scene the day of the call, but Reitz failed to show that officer John Wilson and investigator Larry Tatum made false statements to have him arrested after a more complete investigation, the opinion by Judge Jennifer Walker Elrod said.
