Utz Quality Foods is free of wage-and-hour allegations after a delivery worker left it out of an amended complaint, prompting a federal court to dismiss the snack food company from the suit.
The delivery worker accused Utz Quality Foods Inc. and Utz Quality Foods LLC of misclassifying him as an independent contractor when he was really an employee entitled to overtime pay. But Utz doesn’t employ any delivery drivers in New York City, and the man actually worked for an independent snack food distributor, the company told the US District Court for the Southern District of New York.
