Walmart Inc. must defend a lawsuit alleging that it violated California’s wage and hour rules, after the Ninth Circuit on Thursday revived a former fulfillment center employee’s Private Attorney General Act claims.
Walmart argued that plaintiff Alyssa Hernandez was barred from pursuing her PAGA claims because she didn’t seek class certification under Rule 23 of the Federal Rules of Civil Procedure. But an employee asserting a PAGA cause of action doesn’t need to satisfy the requirements for a class action to proceed, the US Court of Appeals for the Ninth Circuit said.
