The False Claims Act has long been the U.S. Department of Justice’s primary tool for combating civil fraud on the federal government. Under the second Trump administration, the FCA has also become a tool for top-down enforcement of core policy interests, such as the Administration’s high tariffs and its historic moves against the diversity, equity, and inclusion policies of government funding recipients. Amid these developments, the DOJ’s use of the FCA to continue testing novel theories of fraud related to complex government regulatory regimes, such as Department of Defense cybersecurity requirements and federal health care programs, continues in full force.
