A whistleblower attorney’s “reckless” use of an AI tool in a False Claims Act retaliation suit requires a sanction in the form of attorneys’ fees and costs, a Washington, DC judge said.
Glenn Ellis, a Philadelphia-based solo practitioner, included erroneous legal authorities in a brief because of his exclusive reliance on the tool, and the defendant expended unnecessary time and effort because of it, Judge Amit P. Mehta of the US District Court for the District of Columbia said in an Oct. 3 order.
