A whistleblower lawsuit by a former Vallejo deputy police chief was dismissed Thursday.
Former Deputy Chief Joe Gomez alleged in a lawsuit filed April 23, 2025 that he was fired after reporting violations of deadlines for officer proceedings, mishandling of investigations, instances of potential misconduct, organizational deficiencies and resistance to supervision and accountability measures.
The city filed a demurrer to Gomez’s complaint saying he failed to allege facts to support his whistleblower claims or to identify the statutes, rules, or regulations that were supposedly violated.
Solano County Superior Court Judge Alesia Jones issued an order Friday sustaining the city’s demurrer without leave to amend.
“Plaintiff does not allege that he disclosed any information he reasonably believed was a violation of law to an authority,” Jones said in her ruling. “He does not allege facts showing that he disclosed anything in particular to the interim chief of police.”
Jones continued, “He does not allege facts that he had a reasonable belief that any law was being violated . . . As plaintiff does not sufficiently allege that he disclosed a believed violation of law to an authority he does not sufficiently allege that he suffered an adverse employment action due to such a disclosure, either.”
