Whistleblower’s Crimes Bar $1 Million Fraud Settlement Share - Bloomberg Law News

A Massachusetts man who pleaded guilty to drug crimes isn’t entitled to a share of a False Claims Act settlement the US government received from behavioral health organization Bournewood Health Systems, a federal district court said.

David Perry filed a whistleblower suit in 2021 accusing Bournewood of engaging in a kickback scheme that defrauded the government. The suit resulted in a 2024 settlement worth $6.5 million, but Perry’s role in the scheme and his convictions prevent him from receiving any share, let alone his request exceeding $1 million, Judge William G.
