JEREMY MAGGS: This is the Tuesday edition, and we’ll start with this, South Africa’s corruption pandemic has, in some instances, been laid bare by whistleblowers. But says, a leading local law firm, a change of mind is urgently needed by employers to understand the risks attached to the practice. The issue has been raised by Tendai Jangara, who is a director in dispute resolution at the law firm Cliffe Dekker Hofmeyr. She’s with us now. So this is not a new call; why are you making it again?
TENDAI JANGARA: So, Jeremy, we find ourselves in a position where we are looking at reforming our whistleblower regime, so the legislation that we have. But we also see that the cases of whistleblowers suffering detriment are continuing. We’re not getting to a point where these cases are abating, where we see an improvement in how whistleblowers are being treated.
So we need to continue to talk about this issue, revisit our law, and look at what consequences people are suffering as a result of reporting any cases of malfeasance that they become aware of in their organisations.
