Will Amendment 3, recreational marijuana, impact Missouri workforce? - News-Leader

Under Amendment 3, employers may discharge or discipline an employee for being under the influence at work.

Missourians approved the legalization of recreational, adult-use marijuana last week in a close midterm race. With less than one month until Amendment 3 is added to the state constitution, questions still linger about the new legislation's impact, including marijuana's place in the workplace.

This workplace presence is dependent on an employer, as Amendment 3 allows an employer to terminate or discipline an employee for being under the influence of marijuana while at work.

Workplace discipline will vary by employer, but generally it includes things like written warnings, demotions or suspensions without pay, John Payne, Legal Missouri campaign manager, said. Legal Missouri 2022 is the organization that has backed Amendment 3 since its inception.

When it comes to specific tasks in the workplace, Amendment 3 does not allow the consumption of marijuana (recreational or medical) while being in physical control of any "motor vehicle, train, aircraft, motorboat or other motorized form of transport." Amendment 3 also does not allow folks to be under the influence of marijuana while operating these modes of transportation, even if they consumed it prior.
