A class action accusing Yale University of mismanaging its retirement plan is heading to trial after a Connecticut federal judge found lingering factual questions on the case’s core claims of high recordkeeping fees and poor investment monitoring.
A trial is needed to determine whether the Yale defendants breached their fiduciary duties under ERISA by not consolidating retirement plan recordkeepers sooner, by failing to obtain competitive bids for these services, and by using an asset-based pricing model for recordkeeping fees, Judge Alvin W.
