The Supreme Court’s decision over status of contractors will have wide-ranging implications for the gig economy

Last month, the Supreme Court delivered its highly anticipated judgment on the case taken by the Revenue Commissioners against Karshan (Midlands) Ltd, which trades as Domino’s Pizza.

The case concerned a dispute over the employment status of delivery drivers working for Karshan and generated significant attention over the last number of years due to the potential consequences for those working in the “gig economy”.

Prior to this, the seminal Irish cases on employment law involved a supermarket demonstrator for Henry Denny & Sons, meter readers for ESB, temporary veterinary inspectors for Galtee Meats, and Irish Coast Guard volunteers.

The British courts have recently considered the status of Uber and Deliveroo drivers, and we can now add pizza delivery drivers to this somewhat motley crew.

The Supreme Court ruling last month has provided some clarity by setting out a five-step test to determine employment status, which has been under ongoing review by the Revenue Commissioners and the Department of Social Protection since the foundation of the Irish state.
