Express Scripts Inc. is free of a worker’s wage-and-hour class allegations after a federal judge took another look at the company’s motion for summary judgment and determined that an exemption from federal overtime requirements applied.
A previous ruling used the wrong test to assess whether the former senior program communications manager who filed the class case was a highly compensated employee exempt from overtime pay, and under the correct test, Express Scripts deserves summary judgment, the US District Court for the District of New Jersey said.
