More employees join lawsuit against Publix over alleged unpaid overtime - NBC Montana

WEST PALM BEACH, Fla. (CBS12) — More employees are stepping forward in the collective action lawsuit over alleged off-the-clock work at Publix.

The lawsuit was originally filed on October 26 highlighting assistant managers who worked at stores in Florida, Tennessee and Georgia. The lawsuit states they were not only compelled to complete various tasks in the stores before clocking in and after clocking out, but also that they were expected to answer texts from colleagues both after hours and during unpaid lunch breaks. Plaintiffs allege Publix owes them overtime pay for these off-the-clock hours.

On November 21, the Shavitz Law Group — based in Boca Raton — and Morgan & Morgan — based in Orlando — said an amended complaint has been filed to add Publix department managers to the pending lawsuit.

The law groups say they were contacted by multiple hourly-paid department managers who also experienced off-the-clock work regularly for Publix for precisely the same issues as the original complaint and that they too want to pursue backpay damages.

The updated 12-page lawsuit will now include an additional 18 plaintiffs and more are expected the law groups state. The lawsuit continues to allege Publix failed to pay multiple assistant managers and department managers for hundreds of overtime hours which violates the Fair Labor Standards Act of 1938 (FLSA).
