Newsmax settles $67 million defamation lawsuit over false 2020 US election claims - JURIST Legal News

Newsmax has agreed to pay $67 million to settle a defamation lawsuit brought by Dominion Voting Systems over false claims about the 2020 election, the conservative cable network announced Monday.

Dominion was one of several voting machine and election technology companies that helped facilitate voting in 2020, a year when in-person voting was limited by the COVID-19 pandemic. After Joe Biden won that year’s presidential election, various conservative news outlets reported that Dominion machines had been used to manipulate vote counts. Dominion sued several of these outlets, including Fox News, which settled with the election tech firm in April 2023 for nearly $790 million.

In April 2021, Dominion sued Newsmax, alleging the organization had spread conspiracy theories claiming Dominion’s voting technology was manipulated to favor Joe Biden over Donald Trump. The network regularly featured Trump allies like Sidney Powell and Mike Lindell promoting these unsubstantiated theories.

Ruling on a cross motion for summary judgment in April of this year, the Delaware Superior Court found that Newsmax’s statements about Dominion were defamatory per se and false, but held that genuine factual issues remain regarding actual malice and damages.

The settlement was revealed by way of SEC filings submitted last week, and then confirmed by a Newsmax statement. Notably, the outlet claimed the settlement was not an admission of guilt, but rather a conclusion that the trial would not be fair,...
