Norwalk dental providers pay $600K to settle 'False Claims Act' allegations, feds say - Norwalk Hour

NEW HAVEN — Two Connecticut dental providers have entered into civil settlements with federal and state governments to resolve allegations they violated the False Claims Acts, the U.S. Attorney's Office announced Friday.

The settlements stem from a larger investigation into fraud by health care providers who submit kickback-tainted claims to the Connecticut Medical Assistance Program (“CTMAP”) for services to state Medicaid patients referred by third-party “patient recruiting” companies, the U.S. Attorney said in a news release.

In violation of their CTMAP provider agreements and the federal Anti-Kickback Statute, Advanced Dental Center PC, a Norwalk-based dental practice, and its owners, Tal Yossefi, DMD and Elad Yossefi, DDS, submitted claims to CTMAP for services to Connecticut Medicaid patients who were referred to the business by a third-party patient recruiting company, the release said.

Advanced Dental Center paid a patient recruiter for each Connecticut Medicaid patient the recruiter referred to the practice, the release said. With each submitted claim, Advanced Dental Center and its owners implied that conditions of receiving payment were met, including not paying kickbacks or violating any terms or provisions of the Connecticut Dental Health Partnership (“CTDHP”) provider manual. The manual expressly prohibits per-patient compensation for individuals referred to CTMAP providers, the release said.
