Oncologist Fails to Revive Medicare False Claims Act Lawsuit - Bloomberg Law News

A False Claims Act whistleblower failed to convince a federal appeals court Thursday that a lower court errantly sided with his ex-employers whom he accused of fraudulently billing Medicare and other federal programs.

The district court correctly concluded that there wasn’t sufficient, reliable evidence for a jury to find in Robert O’Laughlin’s favor, and that the plaintiff abandoned some of his FCA claims by failing to defend their underlying facts, Judge John B. Nalbandian said.
